The present work proposes a discussion about the typification or, in the specific Brazilian case, the inclusion of feminicide as qualifying circumstance of the crime of homicide as one of the instruments of protection of women in situations of violence. The question is whether criminal law, traditionally patriarchal and used as a control mechanism and associated with the most diverse forms of oppression of minorities, can be converted into a structure capable of preserving the rights of these groups. In order to address the issue of the need to deal with feminicide in criminal law, situations of homicide where the victim is a woman and which has been practiced for gender reasons will be contextualized. It is also intended to bring the femicide / feminicide dichotomy and the interpretative and conceptual possibilities of its derivations from the translation of the English expression. The elements necessary for the characterization of feminicide will be discussed and how best to define it so that it can cover the most varied shades and, at the same time, be associated with situations of vulnerability related to the gender of the victim.
