Resumo: This dissertation aimed to contribute to studies on Rui Barbosa in the field of Brazilian Political Thought, investigating the place and the role of the Judiciary in the political thought of Rui Barbosa. The central argument of the dissertation was that, when dealing with the need to make the Judiciary a strong and independent Power, capable of safeguarding individual freedoms and guaranteeing sincerity to the institutional arrangements of the First Republic, Rui Barbosa executes a “throw” and inaugurates a new political language within the liberal language, the “juridicism”. In order to demonstrate Rui Barbosa's performance and characterize “juridicism” as a sub-language of Brazilian liberal thought, demarcating its essence and its contours, the research was guided by the methodological instrumental offered by the linguistic contextualism of the Cambridge School, with special attention to the teachings of John Pocock. The dissertation also combined elements from the philosophical history of political by Pierre Rosanvallon to Michel Freeden's theory of ideologies. Thus, it was possible to demonstrate how Rui Barbosa presents the notion of independence of Justice with a new meaning, absent among the main ideologies of the Empire and the Republic.

O argumento central do trabalho foi o de que, ao tratar da necessidade de tornar o Judiciário um Poder forte e independente, capaz de resguardar as liberdades individuais e garantir sinceridade aos arranjos institucionais da Primeira República, Rui Barbosa executa um “lance” e inaugura um novo idioma político no interior da linguagem liberal, o “judiciarismo”. A fim de demonstrar a performance de Rui Barbosa e caracterizar o “judiciarismo” como uma sublinguagem do pensamento liberal brasileiro, demarcando sua essência e seus contornos, a pesquisa guiou-se pelo instrumental metodológico oferecido pelo contextualismo linguístico da Escola de Cambridge, com especial atenção para os ensinamentos de John Pocock. Combinou, ainda, elementos da história filosófica do político de Pierre Rosanvallon à teoria das ideologias de Michel Freeden.
