Responsabilidade socioambiental das Usinas Hidrelétricas de Jirau e Santo Antônio em Rondônia: o uso das águas para o desenvolvimento e o respeito à vida

This paper presents the two Hydroelectric Complex Santo Antonio and Jirau on the Madeira River in the State of Rondônia, and its socioeconomic and cultural impacts to traditional communities, especially the riverside who needed to move to Nova Mutum-Paraná constructed as compensatory measure due these impacts. In this context the studies relevant to environmental law legislation were necessary; Art. 215 CF / 1988 deals with the guarantees the full exercise of cultural rights; Decree 6.040/2007; Conama 06/1987 Resolution Studies of Environmental Impacts - EIA and the Environmental Impact Report - Rima, as well as the analyzes conducted by the Public Ministry of the State of Rondônia - MPE -RO on the two hydroelectric plants and the impacts caused to communities in question. Based on this referential provides to the studies the different notes of the EIA / Rima applied to the two cases in view of the concessions of the Environmental License, Installation License and Operating License independent of previous assumptions of the environmental impacts that would require the projects. According to these situations in the documents of the compensatory measures proposed by the two complexes, the problem of the research was based on the investigation of the environmental responsibility of the two Plans, while that examined how the culture of the communities has been achieved in the same way of their social rights. Extends approaches on government programs for the Amazon, known as the Growth Acceleration Program - Pac and Sustainable Amazon Program - Pas, considering that is through these public politicy instruments that the two hydroelectric complex settled in the area. In the tuning fork, needed contextualize the proposals in the history of the Amazon region, in order to understand and reflect on the investments that always used the natural resources of the region, without, however, working right cities and their population. Finally, brings, as traditional communities have to live in the new territory of Nova Mutum-Paraná, in order that the compensation offer described in the two projects would serve the needs of this population. Thence, we conclude that the compensatory measures that would meet the proposed in the EIA/Rima, in response to the use of the forces of Wood River waters for the development of the riverside communities, indicated that they the social and environmental responsibilities are not being targeted as the standardized documents legally as determined the two hydroelectric projects on the Madeira river, Porto Velho, Rondônia
