Aos trancos e barrancos: uma análise do processo de implementação e capilarização do processo transexualizador no Brasil

Resumo: This is a study that aims to analyze the trajectory of institutionalization and implementation of the Transsexualizing Process in Brazil throughout its first 10 years of existence, without disregarding the period, before 2008, in which transgenitalization surgeries were offered to trans people on an experimental basis by the four pioneer university hospitals in this care modality in the country. Thenceforth, we sought to examine the historical constitution of the program between 2008 and 2018, which identified the role played by the Judiciary, the LGBTIQ+ Social Movement, the Ministry of Health, the Professionals/Coordinators and the Researchers, without failing to consider the years prior to the institutionalization of the Program, having as its initial milestone the year 1997, when the Federal Council of Medicine authorized physicians to perform these procedures on an experimental basis. Throughout this study, we sought to investigate the implementation and conduction of this program in the five university hospitals, since the HC of the Federal University of Pernambuco began to perform this care only in 2014, seeking, in this process to understand how the relationship between these units and the management institutions of the SUS took place, as well as trying to identify why the program did not have the full membership of the Health Departments of the states and municipalities for its decentralized implementation. During the study, a field research was undertaken in five states where the university hospitals that conduct the care were visited, in which interviews were conducted with the coordinators and professionals involved in the care. The Ministry of Health was also visited in Brasilia, where it was possible to interview some former policy managers. Throughout the research, some leaders of the social movement were interviewed, as well as some researchers directly involved in the process of building the program and Judge Roger Raupp Rios. Thus, we tried to understand the limits and possibilities of effecting the transsexualizing process as a program of the Unified Health System, and as such, participate in the difficulties that permeate the implementation of this policy since its institutionalization in the 1990s. Among these limits, we sought to point out the characteristics of social formation in Brazil and the historical and cultural difficulties that the country has in dealing with diversity. We sought to situate these difficulties in the milestones of a reality crossed by the logic of state counter-reform and consequent definancing of public social policies in a context of capitalist crisis. In this sense, we sought to understand the limits and weaknesses of the SUS, understanding them as the result of the privatist logic and the interests of national and supranational political and economic power agencies in denying the universal right to health, based on the orientation of minimization of the state in the provision of policies for protection and social security.

A partir desse objetivo, buscou-se examinar a constituição histórica do programa entre 2008 e 2018, onde se identificou o papel desempenhado pelo Judiciário, pelo Movimento Social LGBTIQ+, pelo Ministério da Saúde, pelos Profissionais/Coordenadores e pelos Pesquisadores/as, sem deixar de considerar os anos anteriores a institucionalização do Programa, tendo como marco inicial o ano de 1997, quando o Conselho Federal de Medicina autorizou aos médicos a realização desses procedimentos em caráter experimental. Ao longo desse estudo se buscou investigar a implantação e a condução desse programa nos cinco hospitais universitários, uma vez que o HC da Universidade Federal de Pernambuco começou a realizar esse atendimento somente em 2014, buscando, nesse processo compreender como se deu a relação entre essas unidades e as instancias gestoras do SUS, bem como tentando identificar porque o programa não contou com a adesão plena das Secretarias de Saúde dos estados e municípios para a sua implementação descentralizada. Durante o estudo, empreendeu-se pesquisa de campo em cinco estado onde se visitou os hospitais universitários que conduzem os atendimentos, nos quais foram realizadas entrevistas com os/as coordenadores/as e profissionais envolvidos/as na assistência. Visitou-se também o Ministério da Saúde, em Brasília, onde foi possível entrevistar alguns ex-gestores da política. Ao longo da pesquisa algumas lideranças do movimento social foram entrevistadas, assim como também o foram alguns pesquisadores diretamente envolvidos no processo de construção do programa e o Juiz Roger Raupp Rios. Assim, procurou-se compreender os limites e possibilidades de efetivação do processo transexualizador enquanto um programa do Sistema Único de Saúde, e como tal, participe das dificuldades que perpassam a efetivação dessa política desde a sua institucionalização na década de 1990. Dentre esses limites, buscou-se pontuar as características da formação social do Brasil e as dificuldades históricas e culturais que o país tem em lidar com a diversidade. Buscou-se situar estas dificuldades nos marcos de uma realidade atravessada pela lógica da contrarreforma do Estado e consequente desfinanciamento das políticas sociais públicas em um contexto de crise capitalista.
