Considering the transversal nature of the innovation process; which encompasses economic, social, regional, sectorial, legal, marketing, infrastructure issues, among others, as well as the diversity of legal institutes of intellectual property (Legal Act. 9.279/1996), such as invention patents or utility model patents, industrial design registration, trade mark registration, repression of false geographical indications and unfair competition, among others; it is chosen to contextualize the intellectual property in the cycle of innovation a single case study in order to enable the analysis of the theme in a depth perspective. At this work, we study Embraer's innovation process which is considered a successful case by the specialized literature, in order to identify the relationship between intellectual property institutes and that innovation process in a technology-intensive industry. In this context, it is possible to observe how Embraer has become a reference in innovation without a structured legal apparatus in this sense, thus following very similar paths to those currently institutionalized. Therefore, based on the data extracted from the Decreee n. 770/1969, a documental analysis is carried out, taking into account the economic, political and social contexts, as well as its internal logic. Moreover, through content analysis, the elements that were relevant for the elaboration of the Decree nº 770/1969 are explained, in order, later, to indicate which institutes were effectively anticipated, even before the Act n. 10,973/2004. Chronologically, the study ranges from the creation year of the INPI, 1971, to the date of data collection. The initial term practically coincides with the creation year of Embraer. So, the work theme to be developed is linked to the analysis of intellectual property institutes (rights arising from technology transfer, technical assistance etc.) used by Embraer to appropriate knowledge and carry out its innovation process throughout of the time.
