This dissertation aims to present a theoretical basis, from Freud and Lacan, concerning the application of differential diagnosis in the clinic of addictions in order to refute the equivalence of drug use and psychosis, by location of the operativity of the Name of the Father some clinical cases, even in character weak and outdated. The case of Hans, a case of infantile neurosis postulated by Freud, was taken as a basis and worked throughout the entire dissertation as a way to introduce the study of the anguish and circumscribe the outputs that the structure of neurosis can find to handle the excess pulsional that focuses on the body. If the symptom of Hans came to answer the enigma about the jouissance of the body to represent the truth and the couple's relative, the contemporary symptom, such as drug use in the neurosis, is called an attempt to treat the real by means of an object produced by science, as well as present as the result of the child, in its subjective constitution, to be located in place of the object of fantasy of the mother. In the same way, the study of the Édipo theory allowed us to locate the paternal function in the case of drug use, represented by a fragilization and low operability of the Name of the Father as a consequence of the incidence on subject, the emergence of the real father and the decline of the symbolic father. In this regard, we note that the emergence of the real father and the decline of the symbolic father promotes: the maintenance of the subject in the first time of the Édipo, the decline of the split subject and non-consolidation of fantasy; facts that cause the subject to relate to the object not by through the cause of desire, but the slope of the more-enjoy-particular
