Os vadio de Santana: o controle penal da vadiagem no início do século XX na Cidade do Rio de Janeiro

This dissertation intends to investigate the criminal control over vagrancy crimes during the begining of the First Republic, in Rio de Janeiro. The goal was to situate de actual proceedings of the criminal justice system with the intellectual context and the urban situation in the city of Rio de Janeiro, in order to expose the latent functions of the criminal system. Firstly, it is proposed na interluction between historical and criminological knowledges, finding possibilities of mutual enrichment between the History of Criminal Law and Critical Criminology, resulting in a Criminology through History. Then, it is investigated the main theoretical points of the criminological positivism that was consolidated as the main theory in the Criminal Law thinking in the main centers of legal studies. The finding is that criminological positivism is structured in a scientificist, racist and defensivist manner. Finally, based on de foucaultian concept of biopower and security dispositives it is proposed a reading of the concrete functionality of the criminal system over the vagrants in the city of Rio de Janeiro in the beginning of the XX century, a period of profound urban reforms. It is concluded, in the end, that vagrancy infractions were mobilized by the police with the intention to control the flow of freed populations in the urban territory of Rio de Janeiro
