The thesis aims to investigate the legal aspects of ballast for the issue of “cédula de produto rural” and its impacts on the financing of Brazilian agribusiness. The hypothesis consists of verifying the impacts resulting from the delimitation, or the ampliation, of the concept of rural product for issuing CPR. The method used is the deductive and the research has a juridical-theoretical and exploratory nature, of bibliographic and documentary nature and involves the analysis of national and foreign legislation, in addition to doctrinal studies, jurisprudential decisions, and data provided by official entities. Such material is documented, in a thematic and bibliographic manner, and is the object of qualitative and quantitative, descriptive and statistical analysis. Initially, the legal aspects of Brazilian agribusiness and the history of financing their production is researched. Then, the research examines the role of credit instruments in this context, considering the applicable legislation and the examination of specialized doctrine. It is proposed to deepen the issues related to credit instruments representing goods and their backing. The discipline of the rural product bill is the object of detailed analysis, in light of its applicability as a financing mechanism and the concept of rural product. A comparative analysis is also implemented between the Brazilian and European experiences regarding how the ballast to issue these instruments is delimited. The objective of the thesis is to determine the feasibility of an objective definition for the legal contours of the ballast this banknote and its effects on the financing of Brazilian agribusiness. The work concludes that it is necessary to adapt the CPR ballast to the rural product, without expanding it to manufactured products. To this end, it proposes the creation of an industrial product note that covers products that go beyond the concept of rural.
