This dissertation analyzes oil shale exploration in Brazil and in the United States of America. Shale constitutes an interesting strategic niche to guarantee Brazilian energetic self-sufficiency in the future, considering Brazil´s reserves of this mineral. It is also a possible source of technological development that can put Brazil in the forefront of the international arena. The scientific research over alternative sources of oil might create important technological advantages to this country, in a strategic sector such as energy. The energy sector has its internationalization as a complicating factor. There is great integration of international flows of production, exploration and refining of oil. There is also great interest of foreign companies in investing in the Brazilian energy sector. That creates questions on which sectors of the economy should be opened for foreign investment, and which ones should be directed for national exploration. These questions deserve a thorough analysis in light of the International Investment Law and lex petrolea, to ascertain the pertinence of international investments in this sector of the economy.
