Entre parábolas e teoremas: uma sociologia política de Lava Jato e Mani Pulite

The empirical objects of this work are two anti-corruption operations, the Brazilian Lava Jato and the Italian Clean Hands. The aim is to offer an explicative analysis of how the legal processes can become political in a favorable conjuncture. The incidental approach was elaborated to achieve this aim and it consists of analyzing small fragments of the actions of the actors from the justice system. Incidents are processual elements combined or their combination with elements outside the judicial process to accelerate the course of justice. The use of incidents is strategic and synchronic and it is possible to observe them in cases with high repercussion. To identify the incidents, this work recurred to the systematization of frames (GOFFMAN, 1986) based on the narratives offered by the operators engaged in the processes having as central theme the acting of the system of justice in fighting corruption and positions against, neutral and in favor. In a connected way, both empirical objects were submitted to the same analysis protocol. The research findings are that the frames are produced through the interaction between the political logic, the legal logic, facts, and norms understood from the concepts of normative system (SELZNICK, 1961) and legal sensibilities (GEERTZ; MELLO JOSCELYNE, 2002).
