Resumo: The present work aims to unfold the problem of justice from an anamnetic perspective, interrogating the ethical, political and legal senses that such an approach brings to the theorization of the justice. The goal is to consider the meaning that a posture informed by the memory of injustice produces in front of the juridical-political procedimentalism, represented in the text by the work of John Rawls in A Theory of Justice. For this purpose, a critique is forged to the principles of justice projected a priori, facing the challenges of historical experience, marked by concrete socioeconomic asymmetries and violence directed at individual subjects. The work seeks, therefore, to explain the importance of the experience of injustice as a priority epistemic condition to understand what is justice. In this sense, the text considers the possible meanings of what would be an anamnetic justice. The contributions of Walter Benjamin and Reyes Mate are used to inform the possibility of such a model of theory, that is committed to be a critical opening to the reception of suffering in singular and concrete experiences of injustice, through the perspective of historical responsibility and testimony as an ethical-political key.

O objetivo é considerar o significado que uma postura informada pela memória da injustiça produz frente ao modelo procedimentalista jurídico-político de teorizar o tema, representado no trabalho pela obra de John Rawls em Uma Teoria da Justiça. Para este propósito, realiza-se uma crítica aos princípios de justiça projetados a priori, frente aos desafios da experiência histórica, marcada por assimetrias socioeconômicas e violência concretas dirigidas a sujeitos singulares. O trabalho busca, assim, desdobrar a importância da experiência da injustiça como condição epistêmica prioritária de compreensão do problema do justo. Nesse sentido, são tratados os significados possíveis do que seria uma justiça informada pela memória como ponto de partida de reorganização do problema do justo.
