Resumo: This essay aims to describe, in a systematic approach, the general outlines of the objective limits os res judicata in brazilian civil procedure. In order to reach that objective, some fundamental notions related to the res judiciata and the demanda doctrines in Brazil are described. However, the main goal is to describe the differents legal structures regarding the objective limits of res judicata . Therefore, the major outlines of the restrictive and expansive" theories of the objective limits of res judicata are described, focusing on the main elements of these structures in civil law and common law judicial systems. Most of all, the differences and similarities between the discipline of the theme on the old and the new Brazilian Civil Procedure Code are the objects of examination.

Most of all, the differences and similarities between the discipline of the theme on the old and the new Brazilian Civil Procedure Code are the objects of examination.A presente dissertação tem como objetivo sistematizar conhecimentos acerca da disciplina dos limites objetivos da coisa julgada no direito processual civil brasileiro. Para tanto, são apresentadas noções fundamentais acerca do instituto da coisa julgada no direito brasileiro, bem como relativas ao instituto da demanda e à tríplice identidade. O foco do estudo, entretanto, é a exposição dos diferentes modelos de limites objetivos da coisa julgada. Nesse sentido, são apresentadas as linhas gerais dos modelos restritivo e ampliativo dos limites objetivos da res iudicata, atentando-se para as características gerais que essas estruturas assumem nos países que seguem as tradições jurídicas da common law e da civil law.
