Resumo: This study aims to examine the intersection between police power and the right of manifestation, proposing regulatory parameters to guarantee the exercise of this fundamental right preferred. At first, we present the ills of state ordering activity in addition to its theoretical premises, suggesting a democratic constitutional review of its bases in order to redirect it to the priority realization of fundamental rights at stake, reversing its traditional purpose. Shows up in a second moment, the profound identity between the right to demonstrate and freedom of expression, by marking any difference between them and thus a minimum autonomy of the right of manifestation. Finally, they are enrolled natural tensions verified because of the manifestation of right exercise and the need for balance of interests for solving conflicts with other assets or legally relevant values: comes to police of manifestation, and his related claim, guided by aligned ordinated standard

Em um primeiro momento, são apresentadas as mazelas da atividade ordenadora estatal, além das suas premissas teóricas, sugerindo uma revisão democrático-constitucional das suas bases, de modo a reorientá-la à realização prioritária dos direitos fundamentais em jogo, invertendo-se a sua tradicional utilização. Demonstra-se, num segundo instante, a profunda identidade entre o direito de manifestação e a liberdade de expressão, marcando-se alguma diferença existente entre ambos e, assim, uma mínima autonomia daquele.
