Resumo: Aim of this study is to analyze the legal rules that deal with customs sanctions, in order to identify the limits contained in the Brazilian legal system for their enforcement. To this end, we have examined the distinction among Customs Law, Tax Law and Sanctionatory Customs law, as well as the relationship among Law, coercion and punitive sanction. Following that, we have examined legal interpretation of norms provided by Constitution, Complementary Law and Ordinary Law about enforcement of punitive sanctions. In the end, we have examined how administration and jurisprudence apply legal rules about customs sanctions, in a case study on the issue of the cumulative enforcement of sanctions derived from the infraction of fraudulent interposition in foreign trade and from infraction of assigment of name in foreign trade.

Para tanto, analisa-se, a distinção entre o Direito Aduaneiro e o Direito Tributário, assim como o ramo do Direito Aduaneiro Sancionatório, assim como a relação entre Direito, coerção e a sanção punitiva. Em seguida, examina-se a interpretação dos textos jurídicos e adentra-se na análise das normas constitucionais, da legislação complementar tributária e ordinária em materia de penalidades.
