This thesis analyzes the legal-political struggles that brought the right to strike to the centre of the national political debate from November 1933 to July 1934, in the National Constituent Assembly, and from July 1934 to April 1935, in the Chamber of Deputies. The right to strike in discussions at the National Constituent Assembly will be analyzed from its wide defense by the representatives of employees in speeches registered in sessions that took place from November 1933 to July 1934, in the Proceedings of the National Constituent Assembly of 1933/34. The defense of strike as right sustained by the proletarian minority in the Chamber of Deputies will be approached from the debates that took place in the legislative sessions from July 1934 to April 1935, documented in the Legislative Branch Journal. For understanding the right to strike in its context, in addition to the sources related to the institutional spheres of power, the analysis will make connections with news published in newspapers. During the period analyzed, the right to strike is placed into tangled relations between law and politics; therefore, legal experiences of representatives of employees with strike as a right were transferred to the institutional spheres of power. That said, the understanding of the process of dispute around the political-legal signifier strike and its own history of constitution as a right makes it possible to show how law does not always create the right, but specifically concerning the strike, will serve to criminalize it, in April 1935, by the National Security Law
