A privatização da saúde por meio das Organizações Sociais: a experiência do Rio de Janeiro

The present thesis aims to study the privatization process of Brazilian public health system through the transfer of management to the Social Organizations (OS) in the State of Rio de Janeiro. Its main objective is to analyze the Social Organizations at work in the State of Rio de Janeiro alone and also in Rio and other states as well. And as specific objectives: to discuss the legal and normative milestones of the transfer of public health units to Social Organizations in Brazil; to identify the Social Organizations that operate in the State of Rio de Janeiro: to identify who, when and how they were formed, in which regions of the country they work in specifically in health management; Map and analyze the Contracts Agreements signed between Social Organizations and the Public Administration in the State of Rio de Janeiro; To analyze how much resources were transferred from Health budget to the Social Organizations in the State of Rio de Janeiro, since the institutionalization of Law 6,043, in 2011 until 2015 and, lastly; to identify the irregularities involving the Social Organizations operating in the State of Rio de Janeiro. The methodological proposal adopted is part of the dialectical approach, and its central categories are totality and historicity, seeking to invoke the directions of Brazilian health policy in contemporary society. In order to reach the proposed objectives (general and specific), bibliographical and documentary research were used. The bibliographical research parts from the Marxian analysis on the formation and organization of interest bearing capital and its expressions in contemporary capitalism, targeting to situate social policies in the context of the financialization of capital, emphasizing counter-reforms of the public administration and health policy. The documentary research was based on the normative acts of the Social Organizations in Brazil and in the State of Rio de Janeiro: Laws, norms, ordinances, management contracts published by official press, SES website, Audit Reports from Accounting Court (Cities, State and Union) about the Social Organizations of Health at work in the State of Rio de Janeiro, transparency portal, news in the written and electronic press in general. It stands out as a result of the research that SES-RJ transferred to the management of OSS an approximate value of R $ 9,226,862,262.11. Finally, it is emphasized that the management of OSS has brought losses to the treasury, through various irregularities involving diversion of resources, data fraud and goal achievement, cost premiums among other complaints investigated by the Courts of Accounts Municipalities, States and Union, in addition to the Public Prosecutor's Office. Of the ten (10) OSS contracted by SES-RJ, in the period 2011-2015, six (6) are involved in irregularities involving public resources. SUS workers and users are also harmed by either the flexibilization of labor rights or the scrapping of health services and units.
