Resumo: This article aims to discuss the homosexual identity as well the displacement of the family concept which comes together with this new identity. Concerning its corpus, some judicial decisions, related to some homoaffective issues, and found in the site of the Brazilian Institute of the Family Law (IBDFAM) were analysed. Its aim was to verify the existing controversy concerning the Law professionals´ positions as to these issues. This work was theoretically based on the Discourse Analysis, with a main emphasis on the study and work of Michel Foucault as well as on some theoretical studies such as the ones of Stuart Hall, Tomaz Tadeu da Silva and Zygmunt Bauman, who belong to the field of cultural studies, and work with the question of identity in a discursive perspective. Como corpus deste trabalho, foram analisadas algumas decisões judiciais sobre questões homoafetivas, pesquisadas no site do IBDFAM (Instituto Brasileiro de Direito de Família), para verificar a controvérsia de posicionamento dos profissionais do Direito (juízes e desembargadores). Nosso escopo teórico é o da Análise do Discurso de orientação Francesa, com ênfase nos trabalhos de Michel Foucault e de teóricos do campo dos estudos culturais, como Stuart Hall, Tomaz Tadeu da Silva e Zygmunt Bauman, que trabalham a identidade numa perspectiva discursiva.PALAVRAS-CHAVE  Conceito de família.
