EL TERCERO SECTOR DEBAJO DE LA PERSPCTIVA DEL DERECHO EMPREARIAL: una análisis desde la premisa de la administración gerencial

Resumo: This paper questions the role and efficiency of the performance of the third sector as a state contributor and, even further, ponders the reflexes of the advent of its performance in typically entrepreneurial activities. Given the changes that have taken place in society over time, the State has needed to reduce its structure in order to make it possible to improve the quality of public services provided as a means to achieve an efficient execution of economic activity. It is in this scenario that the State, as the main guarantor of fundamental prerogatives, adopting the neoliberal model, decentralizes its sphere of action, establishing a public-private partnership and acting side by side with civil society, giving rise to regulatory agencies in the Brazilian legal structure. It is then necessary to investigate whether the third sector acts as expected, providing an efficient and less costly service, which, in the final analysis, would legitimize its existence within the Public Administration. To this end, qualitative bibliographic research and the use of the hypothetical-deductive method were carried out.

Dada as mudanças ocorridas na sociedade com o passar do tempo o Estado necessitou enxugar sua máquina com o fim de possibilitar a melhoria na qualidade dos serviços públicos prestados a fim de alcançar uma execução eficiente da atividade econômica. É nesse cenário que o Estado, na qualidade de principal garantidor das prerrogativas fundamentais, adotando o modelo neoliberal, descentraliza sua esfera de atuação, firmando uma parceria pública-privada e agindo lado a lado com sociedade civil, fazendo surgir na estrutura legal brasileira as agências reguladoras. Cumpre, então, investigar se o terceiro setor atua conforme o esperado, prestando um serviço eficiente e menos oneroso, o que, em última análise, legitimaria sua existência no seio da Administração Pública. Para tanto, foram feitas pesquisas qualitativas bibliográficas e utilização do método hipotético-dedutivo.El presente trabajo cuestiona el papel y la eficiencia de la actuación de lo tercero sector como contribución estatal y, más allá, pondera los reflejos de lo adviento de su actuación en actividades típicamente empresarias. Dada las mudanzas ocurridas en la sociedad con el pasar del tiempo el Estado necesito enjugar su máquina con fin de posibilitar a mejoría en la cualidad del servicio público prestado a fin de alcanzar una ejecución eficiente de la actividad económica. Es en este que el Estado, na cualidad de principal garante de las prerrogativas fundamentales, adoptando el modelo neoliberal, descentraliza su esfera de actuación, firmando una asociación pública-privada e actuando lado a lado con la sociedad civil, haciendo surgir en la estructura legal brasileña las agencias reguladoras. Cumple, entonces, investigar si el tercero sector actúa conforme lo esperado, prestando un servicio eficiente e menos oneroso, lo que, en última analicé, legitima su existencia en el centro de la Administración Pública.
