It is up to the State to ensure access to drug technologies by ensuring that these products are used in a rational and scientifically correct manner. This article aims to demonstrate the government's strategic actions to simultaneously keep three major forces in balance: public health, intellectual property and trade, with the aim of guaranteeing access to new drug technologies at a sustainable cost. In this way, we sought to map the impact of abusive exploitation of the patent system, using the drug Sofosbuvir as an example, and the reaction of the government and other organizations to protect the interests of public health in the country. Analyzing the results obtained, it was found that through the strategic use of administrative tools, the government has been successful in its conduct, overcoming judicial clashes and maintaining the principles of the SUS in its three pillars: universality, integrality and equity.
