Artificial Intelligence (AI) has  been used in various sectors of the economy, including agribusiness, which has experienced positive consequences of its application. Therefore, it is necessary to ensure that AI-equipped systems as an intangible asset are adequately protected. Thus, the objective of this paper is to portray the most evident challenges and solutions in the use of AI in agribusiness and to specify the forms of protection of intellectual activity using this technology. The methodology is deductive, exploratory character based on bibliographic research. The results show that AI systems are legally protected under the cloak of intellectual property, specifically in computer program legislation, but because of the complexity of the software development process, the challenge is protecting the technical knowledge and the process that constitutes software development. Therefore, adequate contractual instruments to prevent knowledge leakage are essential.
