Resumo: This study aimed to analyze the criteria adopted by brazilian public universities for the maintenance or abandonment of patents. An exploratory research was carried out with 27 institutions and identified eight institutions with no criteria for the discontinuity of the assets, mainly due to the culture of protection for purposes of better performance in innovation rankings; nine who want to set these requirements and ten that have already implemented the evaluation, although in a non-objective or formally regulated manner. The main criteria used for the dismissal are: consultation of preliminary opinion on the patentability of INPI; analysis of legal, technological, market and institutional aspects; time elapsed between the deposit and the formalization of a license agreement, cost of protection and judgment of convenience and opportunity of public managers. Finally, it was concluded that most universities still lack a methodology for evaluating cases of patent abandonment.

Realizou-se uma pesquisa exploratória com 27 instituições, identificando-se oito sem critérios para a descontinuidade dos ativos, principalmente devido à cultura de proteção para fins de obter melhor desempenho em rankings de inovação; nove delas que pretendem definir esses requisitos e dez que já implementaram a avaliação, ainda que de forma não objetiva ou formalmente regulamentada. Constatou-se que os principais critérios utilizados para a deposição são: consulta de opinião preliminar do INPI sobre a patenteabilidade; análise dos aspectos legais, tecnológicos, mercadológicos e institucionais; tempo decorrido entre o depósito e a formalização de contrato de licenciamento para a exploração da invenção, custo de proteção e juízo de conveniência e oportunidade dos gestores públicos.
