Multiple Intellectual Property Rights Protections for the Computer Program and Jurisprudence Analysis

Summary: Due to the massive production of computer programs for the most diverse applications, the possibilities of protecting these assets must also be understood and well evaluated by developers. This work proposes the identification of the different possibilities of protection by intellectual property right to the computer program, while presenting a jurisprudential analysis of actions involving violations of these rights. The exploratory study was based on the identification and analysis of forms of protection, in particular copyright registration, computer-implemented inventions and industrial design, indicating the characteristics of each one, as well as the advantages of its use. Searches for jurisprudence, based on the use of keywords, reinforce the importance of program protection. Results indicate that the use of multiple protections should be sought whenever possible, which is supported by the analysis of the lawsuits involved.

Este trabalho propõe a identificação das diferentes possibilidades de proteção por direito de propriedade intelectual ao programa de computador, enquanto apresenta uma análise jurisprudencial de ações envolvendo violações a esses direitos. O estudo, de cunho exploratório, baseou-se na identificação e na análise das formas de proteção, em especial o registro de direito de autor, as invenções implementadas em computador e o desenho industrial, indicando as características de cada uma, bem como as vantagens de sua utilização. As buscas por jurisprudências, baseadas na utilização de palavras-chave, reforçam a importância da proteção do programa.
