Resumo: On behalf of certain difficulties with the development of technologies derived from plant organisms, the present study aims to ascertain the scenery of the developed patent with derivatives of vegetal extracts in Brazil and worldwide, and its implications. For this study, patent search was scaled in the last 10 years of applications using Questel ORBIT platform. The most relevant results showed that Brazil has a low concentration of protected technologies derived from plant extracts, all of which with pending status. Gradual reduction of protections was verified at national level, in the past years, and this can be associated to beginning of new legislation of Genetic Heritage access. It was also observed that companies are main assignees of the encountered patent families. Such results may be due to encouraging policies of Intellectual Property, to legislations peculiarities of each country, as well as to incentive interaction between basic research units and companies.

Para tal estudo, foram realizadas buscas dimensionadas nos últimos 10 anos de depósitos por meio da plataforma Questel ORBIT. Os principais resultados evidenciaram que o Brasil apresenta uma baixa concentração de proteção de tecnologias derivadas de extratos vegetais, todas com status pendente. Verificou-se uma redução gradativa das proteções a nível nacional, nos últimos anos, que pode estar associada ao início de vigência da nova legislação de acesso ao Patrimônio Genético. Observou-se, também, que as empresas são as principais depositantes das famílias patentárias encontradas.
