Evaluation of Intellectual Capital in Partnership Agreements and Technology Transfer by Brazilian ICTs with a view to the Legal Framework for Science, Technology and Innovation

Resumo: Intellectual Capital (IC) is a crucial intangible asset in the knowledge economy and within organizations, including Institutes of Science and Technology (ISTs). The Legal Framework for Science, Technology, and Innovation (LFSTI) establishes guidelines for the incorporation of IC in IST agreements. This study aims to identify best practices in ISTs concerning IC in technology transfer contracts aligned with LFSTI. The qualitative research involved a survey conducted among the Technological Innovation Centers (TICs) of Brazilian ISTs. Results indicated that IC assessment encompasses competency mapping, measuring its impact on agreement counterparts, and semi-quantitative evaluation of technical capabilities, know-how, R&D groups, and scientific knowledge of participants. As for valuation, it is conducted indirectly using traditional methods like Royalty Rates, predefined value, and calculation of hours/salary invested in technological development. The study underscores the importance of IC and provides insights into the subject matter.

O Marco Legal de Ciência, Tecnologia e Inovação (MLCTI) estabelece diretrizes para o aporte do CI em acordos das ICTs. Este estudo pretende identificar práticas exemplares nas ICTs em relação ao CI em contratos de transferência de tecnologia, alinhados ao MLCTI. A pesquisa qualitativa envolveu um levantamento nos Núcleos de Inovação Tecnológica (NIT) das ICTs Brasileiras. Resultados indicaram que a avaliação do CI inclui mapeamento de competências, mensuração de seu impacto nas contrapartidas dos acordos e avaliação semiquantitativa de capacidades técnicas, know-how, grupos de P&D e conhecimento científico dos participantes. Quanto à valoração, ela ocorre indiretamente por métodos tradicionais como Royalty Rates, valor predefinido e cálculo de hora/salário empregado no desenvolvimento tecnológico.
