THE FEDERATIVE AGREEMENT AND THE IMPLEMENTATION OF PUBLIC HEALTH POLICY IN BRAZIL

Resumo: | The right to health is an inherent basis for the dignity of the human person. However, the increasing difficulty of access to public services of this nature is evident, leading citizens to routinely appeal to the judiciary to see their rights guaranteed. Faced with this, the following question arises: why is the Judiciary so active in resolving public health issues that the Executive is responsible for executing? In order to answer the problem, our hypothesis is that there is an incongruity between the institutionalization of the powers of the federated entities and the budget composition, which impedes the implementation of public health policies. The objective is to clarify the distribution of powers and revenues among the federated entities to analyze the possible relation of their incompatibility with the administrativeinefficiency of the State. The analysis begins with an explanation of the legislation applicable to the Unified Health System, to explain the way ofoperationalization and the division of competencies by health services among the federated entities. After that, the study on the feasibility of costing public health in Brazil, clarifying the sources of revenue and the percentages of participation of theentities in the national tax collection. Finally, the analysis confirms the hypothesis. |

Le droit à la santé est un fondement inhérent à la dignité de la personne humaine, cependant, la difficulté croissante de la population à accéderaux services publics de cette nature est notoire, amenant les citoyens à faire systématiquement appel à la Justice. Face à cela, la question suivante se pose : pourquoi le pouvoir judiciaire est-il ainsi appelé à résoudre des problèmes de santé publique dont la responsabilité d’exécution incombe aupouvoir exécutif ? Visant à répondre au problème, notre hypothèse est qu’il existe une incohérence entre l’institutionnalisation des pouvoirs desentités fédérales et la composition du budget, qui empêche la mise en oeuvre des politiques de santé publique. L’objectif est de clarifier la répartition des compétences et des revenus entre les entités fédérées pour analyser le rapport éventuel de leurincompatibilité avec l’inefficacité administrative de l’Etat. L’analyse commence par la présentationde la législation applicable au Système Unifié de Santé, afin d’expliquer son opérationnalisation et la répartition des compétences des services de santéentre les entités fédérées. Après cela, une étude est réalisée sur la faisabilité du financement de la santé publique au Brésil, clarifiant les sources de revenus et les pourcentages de participation des entités à la collecte des impôts nationaux. O direito à saúde é fundamento inerente à dignidade da pessoa humana, no entanto, é notória a dificuldade crescente de acesso da população aos serviços públicos dessa natureza, levando os cidadãos rotineiramente a apelar ao Poder Judiciário. Diante disso surge o seguinte questionamento: por que o Poder Judiciário é tão acionado para resolver questões de saúde pública cuja responsabilidade pela execução é do Poder Executivo? Visando responder ao problema, nossa hipótese é que há uma incongruência entre a institucionalização das competências dos entes federados e a composição orçamentária, que impede a implementação das políticas públicas de saúde. Objetiva-se esclarecer as repartições de competências e de receitas entre os entes federados para analisar a possível relação da sua incompatibilidade com a ineficiência administrativa do Estado. A análise inicia-se pela apresentação da legislação aplicável ao Sistema Único de Saúde, para explicitar a forma de operacionalização e a divisão de competências pelas prestações de saúde entre os entes federados. Depois disso, é realizado o estudo acerca da viabilidade de custeio da saúde pública no Brasil, esclarecendo as fontes de receita e as porcentagens de participação dos entes na arrecadação tributária nacional.
