Sociology of public probity and uses of law in “fight against corruption”

Resumo: This article presents the Dossier Sociology of public probity and uses of law in “fight against corruption”, published in the Journal of Social Sciences of the Graduate Program in Sociology of the Federal University of Ceará in July 2022. Since the outbreak of Operation Lava Jato in 2014, the public debate was taken by multiple positions on the proximity of the media to the task force of the operation in Curitiba, on the public probity of political actors and the different uses of criminal legislation by judicial elites – from the Federal Supreme Court to federal public prosecutors. If there is a central connection between these social phenomena, it seems to be the one that reduced the borders between media, politics and law in the country. The implications of this political-legal scandal also left traces in different contexts: from the impeachment of Dilma Rousseff in 2016 to the election of Jair Bolsonaro as president of the Brazilian Republic in 2018; in the arrest and impediment of former president Luiz Inácio Lula da Silva from running in the 2018 elections; in the rise of Sergio Moro as Minister of Justice in Bolsonaro government; and others. In this sense, under a particular privilege of temporal distance from the whirlwind of events that took the country in the last decade, this Dossier sought to group reflections and diagnoses of investigations based on original and empirical data and multiple approaches: public probity in Poland, actors and institutions Brazilian judicial systems (their biographies, their vocations and their reconversions), the impacts of the series of revelations known as Vaza Jato and the connections of journalists with the operators of the law around the moralization of politics.

Desde a deflagração da Operação Lava Jato em 2014, o debate público foi tomado por múltiplos posicionamentos sobre a proximidade dos meios de comunicação com a força-tarefa da operação em Curitiba, sobre a probidade pública de atores políticos e sobre os diferentes usos da legislação penal pelas elites judiciais – do Supremo Tribunal Federal aos procuradores da República em primeiro grau. Se existe uma conexão central entre esses fenômenos sociais, parece ser aquela que reduziu as fronteiras entre o midiático, o político e o jurídico no país. As implicações desse escândalo político-jurídico também deixaram rastros em diferentes conjunturas: do impeachment de Dilma Rousseff em 2016 à eleição de Jair Bolsonaro à presidência da República em 2018; na prisão e no impedimento do ex-presidente Luiz Inácio Lula da Silva em concorrer nas eleições de 2018; na ascensão de Sergio Moro ao Ministério da Justiça do governo Bolsonaro; entre outros.
