Resumo: The water grants in the Brazilian water resources policy is an instrument for rationalizing the multiple uses of water that has been raising doubts about its legal nature, especially in the context of water conflicts. In the absence of a legal stipulation in this regard, the present study seeks to present the main theses about the determination of the legal nature of the water grants from a perspective of regulatory law connected to environmental law. With the support of the bibliographic and normative revision and the analysis of cases of water conflicts within the scope of the National Water Resources Council, it is proposed that the legal nature of the water grant must observe water availability as a mitigating element of administrative discretion. It also analyzes the negative environmental impacts resulting from the reduction of water flow values and the granting of declarations of availability reserve, bearing in mind the precautionary perspective and the interests of those directly involved.

Diante da ausência de estipulação legal nesse sentido, o presente estudo busca apresentar as principais teses quanto à determinação da natureza jurídica da outorga por uma perspectiva de direito regulatório de modo conexo ao direito ambiental. Com amparo da revisão bibliográfica, normativa e da análise de casos de conflitos hídricos no âmbito do Conselho Nacional de Recursos Hídricos, propõese que a natureza jurídica da outorga deve observar a disponibilidade hídrica como elemento mitigador da discricionariedade administrativa.
