Resumo: | The conduct of carrying a firearm without ammunition, according to the positioning of some douctriners, followed by understanding of the Supreme Federal Court, is indeed unusual, for it lacks the capability needed to affecting the characterization of crime. However, there are douctriners that understand that the conduct is typical, following the positioning of the Superior Court of Justice, because, despite the gun devoid of ammunition is not able to make shots, serves as an instrument for the practice of various crimes, bringing in risk legal property of great importance, such as security and public order. The understanding of the Supreme Federal Court, to consider that this conduct is not a crime, is based on various principles of criminal law, such as insignificance, proportionality, minimum intervention, among others, as well as theories that seek to define the concept of crime, as the theory of typical conglobant characteristics. This position, as will be demonstrated, although possessing extensive ballast in doctrine, is against the legislation applicable to the case in kind, which is the Statute of Disarmament, since it was edited with the goal of providing the criminal law and a society instrument of greater repression against crime, aiming to curb the rising crime and public insecurity. |

This position, as will be demonstrated, although possessing extensive ballast in doctrine, is against the legislation applicable to the case in kind, which is the Statute of Disarmament, since it was edited with the goal of providing the criminal law and a society instrument of greater repression against crime, aiming to curb the rising crime and public insecurity.A conduta de portar arma de fogo desmuniciada, segundo o posicionamento de alguns doutrinadores, seguidos pelo entendimento do Supremo Tribunal Federal, constitui fato atípico, por faltar-lhe a potencialidade lesiva necessária para a caracterização de crime. No entanto, doutrinadores há que entendem ser a conduta típica, seguindo o posicionamento do Superior Tribunal de Justiça, pois que, não obstante a arma desprovida de munição não seja apta a efetuar disparos, serve como instrumento para a prática de diversos crimes, pondo em risco bens jurídicos de grande relevância, como a segurança e a incolumidade públicas. O entendimento do Supremo Tribunal federal, no sentido de considerar tal conduta como um indiferente penal, possui embasamento em diversos princípios do direito penal, como os da lesividade, da insignificância, da proporcionalidade, da intervenção mínima, dentre outros, bem como em teorias que buscam definir o conceito de crime, como a teoria da tipicidade conglobante. Tal posicionamento, como será demonstrado, embora possuindo extenso lastro na doutrina, vai de encontro à Legislação aplicável ao caso em espécie, qual seja, o Estatuto do Desarmamento, pois que este foi editado com o objetivo de fornecer ao Direito Penal e à sociedade um instrumento de maior repressão ao crime, visando coibir o aumento da criminalidade e da insegurança pública.
