Resumo: This study aims to show the roll of the State in making effective the principle of Syndical Freedom. Firstly, it is exposed a brief historical retrospect concerning syndicalism in Brazil, which is delimited by the CF/88. Secondly, it is proceeded to a deeper analysis regarding the theme, through the concept of syndical freedom as a fundamental right. Having better defined the principle studied in this paper, it is demonstrated that it is not enough for the syndical movement to have a State that does not intervene in the relationships between the parties, as that does not guarantee the syndicate's freedom. It is the State's roll, then, to assure, through positive attitudes, that the syndicate's freedom is applied practically by the Legislative, the Public Prosecutor and the Judiciary. Finally, the roll of State is studied, by showing court decisions, concerning polemic situations, such as financial issues, democracy and representation in syndicates.

Inicialmente, realiza-se breve escorço histórico acerca do sindicalismo no país, ao final do qual são delimitados os contornos dados ao tema pela Constituição Federal de 1988. Então, passa-se à análise precípua do tema, a partir da conceituação de liberdade sindical, enquadrando-a como um direito fundamental. Devidamente definido o princípio em questão, passa a ser demonstrado que não basta uma atuação negativa do Estado para restar garantida a liberdade dos sindicatos, cabendo a ele, Estado, assegurar, mediante atitudes positivas, que ela será aplicada na prática, por meio do Legislativo, do Ministério Público e do Judiciário.
