Resumo: This work is the aspiration of the problematics modern display around the prison's civil depositary infidel, talking about the conflicting points that involve, to clarify the assumptions on which the civil prison of the depositary infidel is legal or illegal, and also expose about the influence that international treaties have on equalization the theme that, currently, is awaiting legal solution the egregious Supreme Court (STF), Guardian of the Constitutional Charter, based jurisprudence of the country, guiding the judicial protection at all its bodies, shaping the atual operators of the law, especially the imprisonment of the debtor Trust before the Decree No. 911/69 and the validity or otherwise of the international treaty known as the Pact of San Jose in Costa Rica.
