A vulnerabilidade do Direito à moradia e o Poder Judiciário: o caso de Goiânia

This article aimed to investigate how the Judiciary of the state of Goiás decides on litigious cases that impact the right to housing within actions involving the municipality of Goiânia. To do so, a literature review and documentary research on judicial processes were carried out. Initially, the concept and historical background of the right to housing were presented. Regarding International Law, the Universal Declaration of Human Rights served as the basis, and at the domestic level, particular attention was given to Article 6 of the 1988 Constitution. Subsequently, it addressed the jurisdictional function and the structure of the Judiciary of the state of Goiás, as well as the right to property. At last, 55 actions and the content of their judicial decisions were analyzed. Amongst the authors used in this work, notable figures included David Harvey, who addresses capitalist expansion in urban areas, and Ermínia Maricato, who investigates social inequality in urban territory. As a result, this article verified the vulnerability of the right to housing in relation to property, even two decades after its inclusion as a fundamental right.
