CHRISTIAN HUMANISM AND EFFECTIVENESS OF FUNDAMENTAL RIGHTS IN AN EPISTEMOLOGICAL PERSPECTIVE

Resumo: | The present work aims to analyze the humanist proposal to overcome conflicts between fundamental rights, based on the concept of the human person. To this end, the research, of a qualitative nature and motivated by the International Symposium “Diritti Fondamentali e conflitti fra diritti”, promoted in Rome, by the Fondazione Ratzinger, between 15 and 16 November 2018, was carried out through analysis documentary, based on the doctrine about the human person, the principle of human dignity and Christian humanism. Initially, the concept of the human person is analyzed under the philosophical and theological prisms. The principle of human dignity is dealt with in the sequence, identifying Christian foundations, outlining the post-positivist proposal of the law and the historical framework of the process of positivizing that principle. The theology of the theologian Joseph Ratzinger (Pope Emeritus Benedict XVI) is brought up about the “dictatorship of relativism” from which the human person must be preserved. Finally, we explain about Christian humanism, as a concrete proposal to overcome barbarism and found a new society, in which charity and common justice prevail and in which conflicts of fundamental rights are minimized. It is concluded that, despite the variety of rights, legal science, whose core and purpose is the human person, must have mechanisms capable of curbing threats to fundamental rights, especially those linked to the principle of human dignity, and to reconcile the intellectual and ideological strands and positions that, although different from each other, seek, each in their own way, the same objective: the protection and realization of individual rights. |

Para ello, la investigación, de carácter cualitativo y motivada por el Simposio Internacional “Diritti Fondamentali e conflitti fra diritti”, promovido en Roma, por la Fondazione Ratzinger, entre el 15 y el 16 de noviembre de 2018, se llevó a cabo a través de un análisis documental, sobre la doctrina sobre la persona humana, el principio de la dignidad humana y el humanismo cristiano. Inicialmente, el concepto de persona humana se analiza bajo los prismas filosóficos y teológicos. El principio de la dignidad humana se aborda en secuencia, identificando los fundamentos cristianos, perfilando la propuesta pospositivista del derecho y el marco histórico del proceso de positivización de ese principio. La teología del teólogo Joseph Ratzinger (Papa emérito Benedicto XVI) se plantea sobre la “dictadura del relativismo” de la que debe preservarse la persona humana. Finalmente, explicamos sobre el humanismo cristiano, como una propuesta concreta para superar la barbarie y fundar una nueva sociedad, en la que impere la caridad y la justicia común y en la que se minimicen los conflictos de derechos fundamentales. Se concluye que, a pesar de la variedad de derechos, la ciencia jurídica, cuyo núcleo y fin es la persona humana, debe contar con mecanismos capaces de frenar las amenazas a los derechos fundamentales, especialmente los vinculados al principio de dignidad humana, y conciliar la intelectualidad y la dignidad humana. Corrientes y posiciones ideológicas que, aunque diferentes entre sí, buscan, cada una a su manera, un mismo objetivo: la protección y realización de los derechos individuales. Le présent travail vise à analyser la proposition humaniste de surmonter les conflits entre droits fondamentaux, basée sur le concept de la personne humaine. A cet effet, la recherche, de nature qualitative et motivée par le Symposium International «Diritti Fondamentali e conflitti fra diritti», promu à Rome, par la Fondazione Ratzinger, entre le 15 et le 16 novembre 2018, a été menée à travers un documentaire d'analyse, basé sur la doctrine de la personne humaine, le principe de la dignité humaine et l'humanisme chrétien. Dans un premier temps, le concept de personne humaine est analysé sous les prismes philosophiques et théologiques. Le principe de la dignité humaine est traité dans la séquence, identifiant les fondements chrétiens, esquissant la proposition post-positiviste de la loi et le cadre historique du processus de positivisation de ce principe. La théologie du théologien Joseph Ratzinger (Pape émérite Benoît XVI) est évoquée sur la «dictature du relativisme» dont la personne humaine doit être préservée. Enfin, nous expliquons l'humanisme chrétien, comme une proposition concrète pour surmonter la barbarie et fonder une nouvelle société, dans laquelle la charité et la justice commune prévalent et dans laquelle les conflits de droits fondamentaux sont minimisés. Il est conclu que, malgré la diversité des droits, la science juridique, dont le cœur et la finalité est la personne humaine, doit disposer de mécanismes capables de freiner les menaces aux droits fondamentaux, en particulier ceux liés au principe de la dignité humaine, et de réconcilier l'intellectuel des courants et des positions idéologiques qui, bien que différents les uns des autres, visent chacun à leur manière le même objectif: la protection et la réalisation des droits individuels. Il presente lavoro si propone di analizzare la proposta umanista per superare i conflitti tra i diritti fondamentali, basata sul concetto di persona umana. A tal fine, la ricerca, di carattere qualitativo e motivata dal Simposio Internazionale “Diritti Fondamentali e conflitti fra diritti”, promosso a Roma, dalla Fondazione Ratzinger, tra il 15 e il 16 novembre 2018, è stata condotta attraverso analisi documentarie, basate sulla dottrina sulla persona umana, sul principio della dignità umana e sull'umanesimo cristiano. Inizialmente, il concetto di persona umana viene analizzato sotto i prismi filosofici e teologici. Il principio della dignità umana viene affrontato nella sequenza, individuando i fondamenti cristiani, delineando la proposta post-positivista della legge e il quadro storico del processo di positivizzazione di tale principio. La teologia del teologo Joseph Ratzinger (Papa emerito Benedetto XVI) viene sollevata sulla “dittatura del relativismo” da cui va preservata la persona umana. Infine, spieghiamo l'umanesimo cristiano, come proposta concreta per superare la barbarie e fondare una nuova società, in cui prevalgano la carità e la giustizia comune e in cui i conflitti di diritti fondamentali siano ridotti al minimo. Si conclude che, nonostante la varietà dei diritti, la scienza giuridica, il cui nucleo e scopo è la persona umana, deve disporre di meccanismi in grado di frenare le minacce ai diritti fondamentali, in particolare quelli legati al principio della dignità umana, e di conciliare l'intellettuale e filoni e posizioni ideologiche che, sebbene differenti tra loro, perseguono, ciascuno a modo proprio, lo stesso obiettivo: la tutela e la realizzazione dei diritti individuali.O presente trabalho visa analisar a proposta humanista de superação de conflitos entre direitos fundamentais, com base no conceito de pessoa humana. Para tanto, a pesquisa, de caráter qualitativo e que tem por fato motivador o Simpósio Internacional “Diritti Fondamentali e conflitti fra diritti”, promovido em Roma, pela Fondazione Ratzinger, entre 15 e 16 de novembro de 2018, foi realizada por meio de análise documental, com fulcro na doutrina acerca da pessoa humana, do princípio da dignidade humana e do humanismo cristão. Analisa-se, inicialmente, o conceito de pessoa humana sob os prismas filosófico e teológico. O princípio da dignidade humana é tratado na sequência, sendo-lhe identificados os fundamentos cristãos, delineada a proposta pós-positivista do direito e o balizamento histórico do processo de positivação do referido princípio. Traz-se à baila o pensamento do teólogo Joseph Ratzinger (papa emérito Bento XVI) a respeito da “ditatura do relativismo” da qual deve ser preservada a pessoa humana. Finalmente, explana-se sobre o humanismo cristão, enquanto proposta concreta de superação da barbárie e de fundação de uma nova sociedade, em que vigoram a caridade e a justiça comum e na qual os conflitos de direitos fundamentais se minimizam.
