Descomissionamento sustentável de equipamento para exploração de petróleo e gás natural no Brasil

Resumo: Oil is the world's main source of energy. The innumerable benefits it brings to modern society is indisputable. However, this integration and proximity to society, whether in the exploration phase or even in final consumption, has made the sense of responsibility that drives oil operations more latent to all stakeholders. This sense of responsibility is reflected from the extraction process to the decommissioning of the equipment used by the industry, and today we demand greater attention and rigor in complying with the rules of protection to the environment, whether required by national or international standards. Considering the importance of sustainability in the process of decommissioning, whether in the legal or practical part of the process, this paper had the objective of evaluating the sustainability induced by the legislation and the logistic chain for the decommissioning of submarine equipment used in the current oil and gas industry. In order to do so, it was concluded that we have a normative gap to be addressed and a lack of control in the current legislation, but it was verified that the recommendations of decommissioning in Brazil are supported by the current international standards. What is lacking in our context is a standardization of the events that deal with decommissioning, so that it is clear which rules should be applied for each case. The research also showed a lack of transparency among regulators themselves. Also, information that should be available for public domain, for the time being, it is not. The case study carried out at the end of the research showed that it is possible to reuse the materials used to manufacture the equipment that will be decommissioned, as well as estimating the potential market value of the materials taken from the 12 platforms that contemplate Petrobras' decommissioning plan until 2025.

É indiscutível os inúmeros benefícios que ele traz para a sociedade moderna. No entanto, essa integração e proximidade com a sociedade, seja na fase de exploração ou até mesmo no consumo final, fez com que o senso de responsabilidade que conduz as operações petrolíferas se tornasse mais latente em todas as partes interessadas. Esse senso de responsabilidade é refletido desde o processo de extração ao descomissionamento dos equipamentos utilizados pela indústria, e exige-se hoje uma atenção e rigorosidade maiores no cumprimento das regras de proteção ao meio ambiente, sejam elas requeridas pelas normas nacionais ou internacionais. Considerando a importância da sustentabilidade no processo do descomissionamento, seja na parte legal ou prática do processo, essa pesquisa teve por objetivo avaliar a sustentabilidade induzida pela legislação e pela a cadeia logística para o descomissionamento dos equipamentos submarinos utilizados na indústria de petróleo e gás atuais. Para tanto, concluiu-se que temos um hiato normativo a ser tratado e um desencontro nas legislações vigentes, porém ficou constatado que as recomendações de descomissionamento no Brasil encontram respaldo nas normas internacionais vigentes. O que falta no nosso contexto é uma normatização e padronização dos eventos que tratam do descomissionamento, de forma que fique claro quais regras devem ser aplicadas para cada caso. O avanço da pesquisa também mostrou uma falta de transparência entre os próprios agentes reguladores e que informações que deveriam ser de domínio público, por ora, não são disponibilizadas.
