O envolvimento de meninas e mulheres jovens em atos infracionais

Resumo: Great part of Brazilian society has been concerned with the increase of violence and crime rates. Within this context, the academic interest is drawn to studies related to the issue of juvenile offenders, who are erroneously considered directly involved in the matter of public insecurity. In Brazil and in other countries, rises the involvement of women of all ages in criminal activities, especially in drug trafficking. On account of its social and scientific relevance, this study aims to analyze which processes contribute to the involvement of girls and young women in criminal activities. Aged between thirteen and nineteen, twenty female adolescents and young women were subjects of this research. They were either under the social-educational measure of assisted freedom or apprehended at The Female Internment Unit. Interviews were conducted about some aspects of their lives, such as trajectory, involvement in criminal activities, family and love relationships, crimes committed, experience of a social-educational measure and future prospects. In addiction, was applied an inductive instrument in order to investigate some aspects related to the subjects´ life trajectory: my life, to be a woman/to be a girl, to be a man/to be a boy, emotional relationship, family, crime, violence, drug trafficking, death and social-educational measures. The Social Representation Theory was chosen as theoretical approach for its penetration in the field of social and human sciences. Findings were discussed in three articles, namely: “Trajectories of girls in conflict with the law”, “Girls in conflict with the law and drug trafficking” and “Girls: conflict with the law and representations of social-educational measures”. Main data demonstrates that the majority of adolescents had connections with drug trafficking. In the analysis of their trajectories, were verified, within the family context, some factors that have contributed to their vulnerability, such as: presence of family conflicts, personal knowledge of criminals, desire to obtain social visibility. Specially, their social representations of drug trafficking influenced the involvement in criminal activities. The main representational elements were “power”, “fame” and “money”, that indicates social representations of drug trafficking were anchored to social representations of hero. Assisted freedom is represented with the following elements: “reflection”, “living together”, “change of behavior”, “professional attendance”, “re-signification of the act”. The internment is represented by “specialized professional attendance”, “living together”, “reflection”, “growth”, “regret”, “learning”, “professional training”, as well as “bad”, “embarrassing”, “ineffective”, “unjust”, “learning of inappropriate behavior”. The analyses of representations of social-educational measures lead to the conclusion that they can be not configured only as prohibitive life experiences, but indeed as social-educational ones. Nonetheless is observed that freedom privation set elements which question the efficacy of internment as a social-educational measure. Social representations of being a woman/a girl reproduce those ones shared by great part of society, which representational elements are: “respect”, “care”, “responsibility” and “honesty”. The representations of being a woman/ a girl found do not endorse criminal activities, which contributes to an elaboration of future prospects that approach to what is social valued. We believe the study findings may assist the implementation of innovative and emancipating public policy, in order to prevent the involvement of girls in criminal activities, and assure human rights throughout the execution of social-educational measures.

Nesse contexto, amplia-se o interesse acadêmico por pesquisas relacionadas ao tema dos adolescentes em conflito com a lei, visto que são considerados, equivocadamente, como os principais responsáveis pela insegurança pública. No Brasil e em outros países, observa-se a ampliação do envolvimento de mulheres, de diversas faixas etárias, na prática de delitos, principalmente em função do tráfico de drogas. Ao considerar a relevância social e científica desse tema, propôs-se a presente pesquisa que objetivou analisar os processos que contribuíram para o envolvimento de meninas e mulheres jovens na prática de atos infracionais. Participaram do estudo, vinte adolescentes e jovens do sexo feminino, na faixa etária de treze a dezenove anos, que estiveram em conflito com a lei e cumpriam medidas socioeducativas (MSE) de liberdade assistida ou se encontravam acauteladas em Unidade Feminina de Internação. Foram realizadas entrevistas sobre aspectos concernentes à vida das adolescentes: trajetórias; envolvimento de meninas na criminalidade; relacionamentos familiares e amorosos; delitos praticados; vivência da medida socioeducativa; e perspectivas de futuro. De forma complementar, foi aplicado instrumento indutor, com vistas a investigar aspectos relacionados à trajetória das adolescentes: minha vida; ser mulher/ser menina/; ser homem/ ser menino/; relações afetivas; família; crime; violência; tráfico de drogas; morte e medidas socioeducativas. Em função de sua penetração no campo das ciências humanas e sociais, utilizou-se como aporte teórico a Teoria das Representações Sociais. Os resultados foram discutidos, por meio de três artigos intitulados: Trajetórias de meninas em conflito com a lei; Meninas em conflito com a lei e o tráfico de drogas e Meninas: Os conflitos com a lei e as representações das medidas socioeducativas. Os principais dados demonstram que a maioria das adolescentes possuía ligação com o tráfico. Na análise de suas trajetórias, verifica-se a vivência de contextos sócio-familiares que contribuíram para que elas estivessem mais vulneráveis à prática de delitos, tais como: conflitos familiares, convivência com pessoas ligadas à criminalidade, e desejo de obter visibilidade social. Observa-se, sobretudo, a influência das representações sociais (RS) do tráfico de drogas partilhadas, nos envolvimentos das adolescentes em atos infracionais. Os principais elementos representacionais são: poder, fama e dinheiro, a partir dos quais e de outros aspectos analisados, supõe-se que as RS do tráfico de drogas ancoram-se nas RS de herói. Ao cumprir MSE, as adolescentes representam a de liberdade assistida, através dos seguintes elementos representacionais: reflexão, convivência, mudança de comportamentos acompanhamento profissional e ressignificação do ato. A MSE de Internação é representada, por meio dos seguintes elementos: acompanhamento profissional especializado, convivência, reflexão, amadurecimento, arrependimento, aprendizado e profissionalização. De forma expressiva, também são representadas como ruim, constrangedor, ineficaz, injusto e aprendizado de comportamentos inadequados. A partir das RS das medidas socioeducativas, conclui-se que, nos campos pesquisados, a sua execução tem possibilitado a vivência de contextos socioeducativos, e não meramente sancionatórios. Entretanto, observa-se que a privação de liberdade apresenta elementos que questionam a eficácia da aplicação da Internação, como MSE. Verifica-se ainda que, a partir das intervenções promovidas no âmbito da MSE, e demais circunstâncias vivenciadas pelas adolescentes e jovens, as RS de ser mulher/ menina investigadas, passam a reproduzir as RS de mulher, partilhadas por boa parte da sociedade, cujos elementos representacionais são: respeito, cuidado, responsabilidade e honestidade, aspectos que não admitem a prática de atos ilícitos, o que contribui para a elaboração de perspectivas de futuro aproximadas daquilo que a sociedade valoriza. Acreditamos que os resultados da pesquisa contribuirão para a implementação de políticas públicas inovadoras e emancipatórias, a fim de prevenir o envolvimento de meninas com a prática de delitos, e garantir os direitos humanos na execução das MSE.TextARANZEDO, Alexandre Cardoso.
