The production of legality in Argentina’s criminal Justice and the uses of legal framework in a comparative perspective

Resumo: Based on the ethnography developed in Buenos Aires’s criminal justice system, in this article I discuss what I call the production of legality in the investigative process. Considering the procedural reform that gave greater prominence to the public attorneys and separated the powers of investigation and judgment, previously concentrated in the role of the judge, I seek to address how prosecutors and police investigators invest themselves in the adaptation of the legal form of the various investigative procedures developed during the pre-trial stage. This discussion is also based on the method of comparison by contrast with the criminal system in Rio de Janeiro. From this perspective, I seek to contribute to the discussion of how different uses of the legal framework result in different ways of producing evidence, different relationships between the institutions of the judiciary system. Je cherche à aborder comment, à partir de la réforme procédurale qui a donné une plus grande importance au ministère public, en séparant les pouvoirs d‘enquêter et de juger - qui étaient autrefois concentrés dans la figure d‘un juge - les procureurs et les policiers investissent dans l‘adéquation à la forme juridique des différentes procédures d‘enquête développées dans le déroulement de la phase préliminaire du processus. Cette discussion est également basée sur la méthode de comparaison par contraste des travaux et des expériences ethnographiques du système de sécurité publique et de justice pénale à Rio de Janeiro, Brésil. De ce point de vue, je cherche à contribuer à la discussion portant sur les différentes utilisations du cadre légal entraînent différentes manières de produire des preuves, ainsi que la relation entre les institutions du système judiciaire. Em 1998, a reforma processual penal deu maior protagonismo ao Ministério Público, separando os poderes de investigar e de julgar outrora concentrados na figura de um juiz. A partir dessa mudança, busco evidenciar o modo como promotores e policiais investem na adequação dos diversos procedimentos investigativos desenvolvidos à forma legal, na condução da etapa de instrução do processo. Essa discussão se baseia no método de comparação por contraste com experiências etnográficas do sistema de segurança pública e justiça criminal no Rio de Janeiro.
