Resumo: Taking into account the conflicts, gaps and alternatives of the Brazilian legislation regarding the protection of springs, the objective of this paper is to point out and discuss the difficulties in the identification and mapping of springs in Permanent Protection Areas (PPAs), in view of its physiographic, dynamic and typological complexity. For this purpose, proposals are presented for mapping nine springs located in the micro basin of the Fagundes river, in the municipality of Paraíba do Sul (RJ). “Prospected” and “ideal” proposals for mapping springs with characteristics of intermittency and mobility, as well as diffuse, punctual and perennial exfiltration, were drawn up, being close to the model provided by Law 12.651/2012 and idealized by the CONAMA resolution 303/2002, of the Brazilian National Environmental Council. The results indicate that there is a need for approximation of the legislation to the practical reality of the springs, mainly the protected ones, based on scientific knowledge. The protection of watersheds contributing to springs is considered the most adequate solution for these hydrosystems.

The protection of watersheds contributing to springs is considered the most adequate solution for these hydrosystems.Teniendo en cuenta los conflictos, vacíos y alternativas de la legislación brasileña en materia de protección de manantiales, este documento tiene como objetivo señalar y discutir las dificultades en la identificación y mapeo de Áreas de Protección Permanente (APPs) de manantiales, en vista de su complejidad fisiográfica, dinámica y tipológica. Se utilizó como metodología el mapeo propuesto de nueve manantiales ubicados en la microcuenca del rio Fagundes, en Paraíba do Sul (RJ). Fueron elaboradas las propuestas "planificadas" y "ideales" para el mapeo de manantiales con características de intermitencia, movilidad y exfiltración difusa, puntual y perenne, que se aproximan al modelo previsto por la Ley 12.651/2012 e idealizado por la Resolución del Consejo Nacional del Medio Ambiente brasileño - CONAMA 303/2002. Los resultados indican que existe la necesidad de acercar la legislación a la realidad práctica de los manantiales, especialmente de aquellos protegidos, en base al conocimiento científico. La protección de las cuencas hidrográficas que contribuyen a los manantiales se considera la solución más adecuada para estos hidrosistemas.Tendo como panorama os conflitos, lacunas e alternativas da legislação brasileira referente à proteção das nascentes, tem-se como objetivo apontar e discutir as dificuldades na identificação e mapeamento de Áreas de Proteção Permanentes (APPs) de nascentes, em vista da sua complexidade fisiográfica, dinâmica e tipológica. Como metodologia, utilizaram-se as propostas de mapeamento de nove nascentes localizadas na microbacia do Rio Fagundes, em Paraíba do Sul (RJ). Foram elaboradas as propostas “previstas” e “ideais” de mapeamento de nascentes com características de intermitência, mobilidade e exfiltração difusa, pontual e perene, que se aproximam do modelo previsto pela Lei 12.651/2012 e idealizado pela Resolução CONAMA 303/2002 do Conselho Nacional do Meio Ambiente. Os resultados indicam que há a necessidade de aproximação da legislação à realidade prática das nascentes, principalmente as protegidas, tendo como base o conhecimento científico.
