Rights and duties of people with HIV/AIDS in the health: a bioethics view

Resumo: The main focuses of bioethics are the respect and the valorization of human-being. In this sense, the objectives of this study were to investigate the discuss of people with HIV/AIDS concerning to their rights and duties and to analyze theses discusses within bioethical criteria. It is an exploratory work with a qualitative approach. The investigation field was the Assistance to the HIV/AIDS carrier from the university hospital, Lauro Wanderlay of the Federal University of Paraiba. Twenty patients with HIV/AIDS participated of this study. The data was collected during the months of August to September 2006. The responses were qualitatively analyzed by the Collective Subject Speech technique (DSC). The study revealed that most of the rights of the person with HIV/AIDS, according to the DSC of the interviewed people, in the health are not respected, even though they are insured by the Brazilian constitution. Remaining anonymous continues to be a great resource used by the HIV positive carries to insure their rights as a citizen. The study made a reflection possible on the Bioethics area, in special, in the caring for HIV/AIDS patients. Key words: HIV; Bioethics; Health.

Key words: HIV; Bioethics; Health.La Bioética tiene como foco principal el respecto y la valoración del ser humano. Este estudio tuvo como objetivos investigar el discurso de las personas  con VIH/SIDA en lo que se refire  a los derechos y deberes del individuo con esta enfermidad en el campo de la salud; analisar las contestaciones de los participantes a la luz de la Bioética. Se trata de un estudio exploratorio con abordaje cualitativo. El campo de investigación fue el Servicio de Asistencia al Individuo con VIH/SIDA del Hospital Universitario Lauro Wanderley de la Universidad Federal de Paraíba – UFPB. Participaron de este estudio veinte pacientes con VIH/SIDA. Los datos fueron colectados entre los meses de agosto y septiembre de 2006. Las respuestas fueron analizadas cualitativamente a partir de la Técnica del Discurso del Sujeto Colectivo – DSC. El estudio reveló que la mayoría de los derechos de la persona  con VIH/SIDA, según el DSC de los entrevistados, en el campo de la salud no son respetados, a pesar de asegurados por la Constitución Federativa de Brasil. El anonimato continua siendo el arma usada por muchos sueropositivos para tener asegurados sus derechos como ciudadano. El estudio posibilitó una reflexión en el ámbito de la Bioética, en particular, en la práctica de cuidar a la persona con VIH/SIDA. O campo de investigação foi o Serviço de Assistência ao Indivíduo com HIV/AIDS do Hospital Universitário Lauro Wanderley da Universidade Federal da Paraíba. Participaram do estudo vinte pacientes com HIV/AIDS. Os dados foram coletados durante os meses de agosto e setembro de 2006. As respostas foram analisadas qualitativamente, a partir da Técnica do Discurso do Sujeito Coletivo (DSC). O estudo revelou que a maioria dos direitos da pessoa assim acometida, segundo o DSC dos entrevistados, no campo da saúde, não são respeitados, apesar de assegurados pela Constituição Federativa do Brasil. O anonimato continua sendo a arma usada por muitos soropositivos, para eles terem garantidos seus direitos de cidadão. O estudo possibilitou uma reflexão no âmbito da Bioética, em particular, na prática do cuidar da pessoa com HIV/AIDS.
