Resumo: The present work uses the conceptual framework of origin of the first conceptions of legal realism, its exponents, and the possible perception of some of these jusrealistic ideas in the doctrine and jurisprudence of Brazilian law through an analysis of the convergence and approximation processes between its main discussions. It seeks to promote, using the dialectical method, an analytical reflection on the idea that the Law would be what the Courts and judges define it to be, through their judicial decisions. It seeks to clarify the limitations of judicial discretion in the Democratic Rule of Law in which decisions must be made based on the coherence and integrity of the law.

Busca promover, pela utilização do método dialético, uma reflexão analítica sobre a ideia de que o Direito seria aquilo que os Tribunais e juízes definem que é, por meio de suas decisões judiciais.
