The Inter-American Court of Human Rights has more and more demands involving the human rights violation, and Brazil has eight convictions before the body. More than ten years after the first conviction, the country has only one sentence fulfilled – the Escher and others case vs. Brazil – in full, which allows it to be questioned, using the inductive method: which elements differentiate it from the other cases pending compliance? The objective, therefore, is to discuss the Inter-American Court of Human Rights’ performance in order to analyze the Escher case, as well as the non-compliance with the Court’s judgments and the elements brought about it in the enforcement of the judgment in the present case. It is possible to conclude, in light of the analyses made, that the nature of the convictions imposed is a decisive factor in the full compliance with the decisions, with the Escher case not having determinations regarding the implementation of public policies or legislative adaptions.
