Resumo: This article aims to be a contribution to the sociology of Latin American law, seeking to find the causes of the discourse of law, that is, to answer the question of why the law says what it says and nothing else in this region of the American continent. Although each nation-state constituted in Latin America has had its own history and distinct geographic, social and cultural specificities, it is possible to say that they share forms of social control and organization of violence, due to their colonial history and insertion to the world capitalist system, and to reach the conclusion that knowing the discourse of law in Latin America is essential to think about the necessary transformations for the well-being of our societies. Thus, to be able to reveal critically how the law contributed to social control in the region and what possibilities this discourse can present to the struggle and resistance of the people for a dignified life, it is essential to turn to the sociology. Therefore, this article seeks to be a contribution that can help to understand critically the law and its effects on societies in the region today.

A pesar de que cada Estado-nación constituido en América Latina haya tenido su historia propia y especificidades geográficas, sociales y culturales distintas, es posible afirmar hoy día que comparten formas de control social y organización de la violencia, debido a su historia colonial e inserción al sistema capitalista mundial, y llegar a la conclusión de que conocer el fenómeno jurídico en América Latina es imprescindible para pensar las transformaciones necesarias para el bien vivir de nuestras sociedades. Así para ser posible desvelar críticamente de qué manera el derecho contribuye al control social en la región y qué posibilidades puede presentar este discurso a la lucha y resistencia de los pueblos por una vida digna, imprescindible volcarse sobre la sociología.
