The study intends to answer the following research problem: can the inadequate reasoning of judicial decisions be considered as an error in procedendo, giving rise to the State responsibility? The research is based on a case study and uses two events of compulsory sterilization by judicial authorization in Mococa, São Paulo, in 2017. The study addresses the State civil liability for judicial error, the principle of free conviction of the judge and reasoning for decision. The approach is qualitative, based on a literature review and the periodization takes place between 2017 and 2019, considering the date of the sterilization lawsuits and the disciplinary complaint against the judge responsible for the analyzed cases. It is concluded that the inadequate reasoning in the studied cases don’t characterizes non-compliance with functional duties and, between this and that, it does not show any deviation from the legal model outlined by the procedural legislation by the judge in the case.
