Resumo: | Human existence has always been linked to food consumption, which, in addition to contemplating the physical and nutritional completeness of individuals, are part of the culture and inherent to the social issues of the most diverse social categories. However, the capitalist means of production that have intensified due to the neoliberal globalization have hit the contemporary market, affecting everything that is produced and placed as a product, including food. Agriculture, one of the main agrarian activities currently developed as one of the basis of agricultural politics that are part of the construction of contemporary agricultural law, was subsumed by capitalism, once its production (food) was transformed into food and commodities regimes, controlled by the agrarian companies. All this process of territorialization of food has removed its character of human right, transforming the meaning of agrarian law contemporaneously as companies were building food empires that control the worldwide production and marketing of food throughout the planet. These empires hide a multiplicity of subjects of the field, withdrawing their means of production and conditioning them to produce according to the demands of the market. Among these subjects, women from the countryside stand out, represented here by the Peasant Women's Movement, who suffer from a triple invisibility and can’t "speak" in the global neoliberal organization ruled by capital. This study, through qualitative research, having as theoretical reference the authors of the Critical Theory of Human Rights, intends to analyze the following legal problem: the agrarian enterprise is the object of Agrarian Law. Facing this problem, it is proposed the hypothesis that there is a perspective of Contemporary Agrarian Law in which the subjects are not invisibilized and that their cultures and their social means of production are valued, so that the food returns to being part of the most diverse territorialities. |

Entretanto, o modo de produção capitalista que se intensificou com a globalização neoliberal atingiu o mercado contemporâneo, afetando tudo que é produzido e colocado como produto, inclusive os alimentos. A agricultura, uma das principais atividades agrárias desenvolvidas atualmente uma das bases de política agrícola que compõe a construção do Direito Agrário Contemporâneo, foi subsumida pelo capitalismo, uma vez que seus frutos (os alimentos) foram transformados em regimes alimentares e commodities, ficando a serviço das empresas agrárias. Todo esse processo de territorialização dos alimentos lhes retirou o caráter de direito humano, transformando a acepção de Direito Agrário contemporaneamente à medida que foram sendo construídos impérios alimentares que comandam a produção e comercialização mundial de alimentos em todo o planeta. Os referidos impérios invisibilizam uma multiplicidade de sujeitos do campo, lhes retirando seus modos de produção e os condicionando a produzir a medida das exigências do mercado. Dentre esses sujeitos, destacam-se as mulheres do campo, aqui representadas pelo Movimento de Mulheres Campesinas, as quais sofrem com uma tríplice invisibilização e não “podem falar” na organização global neoliberal pautada pelo capital. O presente trabalho, por meio de pesquisas qualitativas, tendo como referencial teórico os autores da Teoria Critica dos Direitos Humanos, pretende analisar o seguinte problema jurídico: a empresa agrária é o objeto do Direito Agrário.
