This work aims at the financialization of environmental preservation assumed by New Brazilian Forest Code, Law 12,651, of May 25, 2012, through the Environmental Reserve Quota (ERQ). The present study aimed to present the setting, the dynamics and the difficulties of seeking to preserve the environment by using of privatizing protection. The dialogue established implies responsibility in dealing and coping dialogues and research that impact the environment and the very law enforcement. The guiding concern of the research is the analysis and understanding of these structures that impact the environment contrasted with conservative perspectives. The study of that law tames crossovers paths in the context of human-nature dimension. The research was developed through a literature review and study of the New Forest Code and the Direct Actions of Unconstitutionality proposed so far. The results show the importance of rethinking the preservation instrument of the law, even with limited data for the complete evaluation of your goals, due to a model that refusal coping political actions to productive interests and that can be truly effective.
