Resumo: Current research aims to address the possibility of reconciling or not the principle of free enterprise and the effectiveness of fundamental rights as an instrument of sustainable development. To this end, a bibliographical research is undertaken and the method applied is deductive. The theoretical framework used in this work is centered on the Economic Analysis of Law, especially with regard to the concepts of Pareto efficiency, without prejudice to the use of the development theory articulated by Amartya Sen. The study advances by finding that weighting, proportionality, and Pareto efficiency can act together to achieve a balance between present and future needs. As a result, it was found that, by means of the weighting technique, the principle of free enterprise allows restrictions, having sustainable socioeconomic development as its guiding factor.

Para tanto, é empreendida uma pesquisa bibliográfica e o método aplicado é o dedutivo. O referencial teórico utilizado neste trabalho se centra na Análise Econômica do Direito, máxime no que concernir aos conceitos de eficiência de Pareto, sem prejuízo da utilização da teoria do desenvolvimento articulada por Amartya Sen. O estudo avança ao constatar que a ponderação, a proporcionalidade e a eficiência de Pareto podem atuar conjugadas para se alcançar o equilíbrio entre as necessidades presentes e futuras.
