Business Complicity, Transitional Justice and Indigenous Peoples Human Rights Violations in the Civil-Military Dictatorship of 1964-1988 in Brazil

Resumo: This article presents a systematization of human rights violations in indigenous peoples in Brazil committed by companies during the civil-military dictatorship (1964-1988), which were identified by the National Truth Commission. Based on the observation of the existence of two development models in permanent conflict in Brazil and also in Latin America, the article will relate the mechanisms and practices related to Transitional Justice with the studies and notes that have been developed by researchers in the Business and Human Rights, indicating a fourth generation in transitional studies, which seeks to bring these two areas closer together under the name of Corporate Transitional Justice or Business Complicity in Transitional Justice. A systematization of human rights violations against indigenous peoples committed by companies is carried out in sequence, based on the Final Report of the National Truth Commission of Brazil. Combine the theoretical referential to the data  Report, it is concluded that a lacuna still persists in relation to the violations perpetrated against the indigenous peoples, which needs  to be highlighted, in order to contribute the investigations and debates on the transition in Brazil.

A partir de la observación de la existencia de dos modelos de desarrollo en permanente conflicto en Brasil y también en América Latina, el artículo relacionará los mecanismos y prácticas relacionados con la Justicia Transicional con los estudios y apuntes que han sido desarrollados por investigadores en el campo Derechos Humanos y Empresas, indicando una cuarta generación en estudios transicionales, que busca acercar estas dos áreas bajo la denominación de Justicia Transicional Corporativa o Complicidad Empresarial en Justicia Transicional. A continuación, se realiza una sistematización de las violaciones de derechos humanos contra los pueblos indígenas cometidas por empresas, con base en el Informe Final de la Comisión Nacional de la Verdad de Brasil. Al combinar el marco teórico antes mencionado y los datos señalados en dicho Informe, se concluye que aún persiste una brecha en relación a las violaciones perpetradas a los pueblos indígenas, que merece ser destacada, con el fin de contribuir a las investigaciones y debates sobre la transición en Brasil. Para la elaboración del artículo se utilizó una investigación exploratoria en doctrina y jurisprudencia, priorizando el método inductivo.Este artigo apresenta uma sistematização das violações de direitos humanos dos povos indígenas no Brasil praticadas por empresas durante a ditadura civil-militar (1964-1988), identificadas pela Comissão Nacional da Verdade. A partir da constatação da existência de dois modelos de desenvolvimento em conflito permanente no Brasil e, também, na América Latina, o artigo relaciona os mecanismos e práticas atinentes à Justiça de Transição com os estudos e apontamentos que vêm sendo desenvolvidos pelos pesquisadores do campo Direitos Humanos e Empresas, que indicam uma quarta geração nos estudos transicionais, ao procurar reunir essas duas áreas sob a denominação de Justiça de Transição Corporativa ou Cumplicidade Empresarial na Justiça de Transição. Na sequência, é realizada uma sistematização das violações de direitos humanos contra os povos indígenas praticadas por empresas, a partir do Relatório Final da Comissão Nacional da Verdade do Brasil. Ao conjugar o referencial teórico mencionado e os dados apontados no referido Relatório, conclui-se que uma lacuna ainda persiste em relação às violações perpetradas contra os povos indígenas, a qual merece ser destacada, a fim de contribuir nas pesquisas e debates sobre a transição no Brasil.
