Resumo: This paper aims to discuss Decree n. 9.571/2018, which establishes the National Guidelines on Business and Human Rights for medium and large business enterprises. The analysis is based on two aspects, which demonstrate the illegitimacy and insufficiency of the aforementioned decree to address the serious human rights violations resulting from business activities in Brazil: (i) the lack of social participation in the development of Decree n. 9.571/2018 and (ii) the non-binding nature of its provisions.
