Duty of surveillance, human rights and transnational corporations: a review of the different models of fight against impunity

Resumo: The article starts from the need to develop internationally binding standards on transnational corporations and human rights that would put an end to the impunity enjoyed by the former when, directly or through the various links in their supply chain, they cause violations of these rights, as well as ensuring reparation for the victims. The textile sector, fundamentally in the links of the supply chains located in different countries of Asia, is one of those that presents a greater index of violations of human rights in general and labor rights in particular. For this reason, the article uses the example of this sector to highlight both the impact of these violations and the ineffectiveness of the mechanisms currently in place to prevent them. This statement is made in the article together with the recognition of the existence of normative frameworks already in force, such as French law, and ongoing initiatives, such as the Sanchez-Candeltey Initiative, which represent progress in the establishment of binding standards that subject the actions of transnational companies to respect for Human Rights. However, and this is the fundamental thesis of the article, these initiatives continue to be partial for the control of entities such as TNCs, which because of their transnational activity easily escape the control established in state or regional normative frameworks. In this sense, the article argues that the essential element to achieve the end of impunity and to advance towards the eradication of phenomena such as modern slavery is the adoption of a legally binding international instrument, such as the one being negotiated in the framework of Resolution 26/9.

El sector del textil, fundamentalmente en los eslabones de las cadenas de suministro situadas en distintos países de Asia, es uno de los que presenta un mayor índice de vulneraciones de los derechos humanos en general y laborales en particular. Por este motivo, el artículo utiliza el ejemplo de este sector para evidenciar tanto el impacto de estas violaciones como la ineficacia de los mecanismos actualmente vigentes para prevenir las mismas. Esta afirmación se cohonesta en el artículo con el reconocimiento de la existencia de marcos normativos ya vigentes, como la ley francesa, e iniciativas en curso, como la Iniciativa Sánchez-Candeltey, que suponen un avance en el establecimiento de normas vinculantes que sujeten la actuación de las empresas transnacionales al respeto de los Derechos Humanos. Sin embargo, y esta es la tesis fundamental del artículo, estas iniciativas continúan siendo parciales para el control de entidades como las ETN, que por su actividad transnacional escapan con facilidad del control establecido en marcos normativos estatales o regionales. En este sentido, se argumenta en el artículo que el elemento imprescindible para alcanzar el fin de la impunidad y avanzar hacia la erradicación de fenómenos como el de esclavitud moderna es la aprobación de un Instrumento internacional jurídicamente vinculante, como el que se está negociando en el marco de la Resolución 26/9.O texto parte da afirmação da necessidade de desenvolver normas internacionalmente vinculativas sobre empresas transnacionais e direitos humanos que ponham fim à impunidade de que gozam as primeiras quando, directamente ou ao longo dos vários elos da sua cadeia de abastecimento, provocam violações desses direitos, bem como de assegurar a reparação das vítimas. O setor têxtil, fundamentalmente nos elos das cadeias de valor localizados em diferentes países da Ásia, é um dos que apresenta um maior índice de violações dos direitos humanos em geral e dos direitos laborais em particular. Por este motivo, o artigo utiliza o exemplo deste setor para realçar tanto o impacto destas violações como a ineficácia dos mecanismos atualmente em vigor para as evitar. Esta declaração é feita no artigo juntamente com o reconhecimento da existência de quadros normativos já em vigor, como o direito francês, e iniciativas em curso, como a Iniciativa Sanchez-Candeltey, que representam um progresso no estabelecimento de normas vinculativas que sujeitam as ações das empresas transnacionais ao respeito pelos Direitos Humanos. Contudo, e esta é a tese fundamental do artigo, estas iniciativas continuam a ser parciais para o controle de entidades como as TNCs, que devido à sua atividade transnacional escapam facilmente ao controle estabelecido nos quadros normativos estatais ou regionais.
