Resumo: This article addresses the issue of the participation of affected people in the reparation process for the damage suffered by the violation of human rights by companies. It starts from the concept of the affected person as the key to building the role of the affected populations in the reconstruction of their lives after socio-technological disasters, taking as its founding principle the centrality of the victim's suffering. The analysis, based on participant observation, finds numerous failures in the realization of the right to popular participation in decision-making. Finally, a brief overview of the lessons learned with the cases of Rio Doce and Paraopeba is presented.

Se parte del concepto de persona afectada como clave para construir el papel de las poblaciones afectadas en la reconstrucción de sus vidas tras los desastres socio-tecnológicos, tomando como principio fundacional la centralidad del sufrimiento de la víctima. El análisis, basado en la observación participante, encuentra numerosas fallas en la realización del derecho a la participación popular en la toma de decisiones. Finalmente, se presenta un breve resumen de las lecciones aprendidas con los casos de Rio Doce y Paraopeba,O presente artigo aborda o tema da participação das pessoas atingidas no processo reparatório dos danos sofridos pela violação aos direitos humanos por empresas. Parte-se do conceito de pessoa atingida como chave para a construção do protagonismo das populações atingidas na reconstrução de suas vidas após desastres sociotecnológicos, tomando como princípio fundante a centralidade do sofrimento da vítima. A análise, baseada na observação participante, constata inúmeras falhas na efetivação do direito à participação popular na tomada de decisões.
