Gold mining and tribal peoples: a study in the light of the understandings of the Inter-American Court and the Brazilian example

Resumo: This paper aims to compare the practice of gold extraction in the Brazilian Amazon with the national and international standards of protection of traditional peoples. These peoples are often affected by economic activities that impact the environment, especially because of the specifics of their culture, which often has particularly close relationships with the environment in which they live. The hypothetical-deductive method was used, postulating that the country has not protected these peoples. To confirm the hypothesis, the conduct of the Brazilian state was compared with national and international normative frameworks for the protection of human rights and traditional peoples, identified in the decisions of the Inter-American Court of Human Rights and the Supreme Federal Court through the method of jurisprudential analysis. It was possible to observe that Brazil does not act in accordance with the standards dictated by the Inter-American Court and its own constitutional court, and thus tribal peoples remain on the margins of state protection and suffer from the negative impacts of gold extraction by mining companies and their byproducts. Even with the provision of binding standards of protection, these are routinely disregarded. Effective, not merely performative, actions are needed to guarantee the protection of traditional peoples and eliminate the risk of the country being held accountable before the Inter-American Court.

Estos pueblos son afectados por actividades económicas que repercuten en el medio ambiente, sobre todo debido a las especificidades de su cultura, que incluye relaciones especialmente estrechas con el entorno en el que viven. Se utilizó el método hipotético-deductivo, postulando que el país no ha protegido a estos pueblos. Para confirmar la hipótesis, se comparó la conducta del Estado brasileño con los marcos normativos nacionales e internacionales de protección de los derechos humanos y de los pueblos tradicionales, identificados en las decisiones de la Corte Interamericana de Derechos Humanos y del Supremo Tribunal Federal, a través del método de análisis jurisprudencial. Se pudo observar que Brasil no actúa de acuerdo con las normas dictadas por la Corte Interamericana y su propio tribunal constitucional, por lo que los pueblos tribales permanecen al margen de la protección estatal y sufren los impactos negativos de la extracción de oro por parte de las empresas mineras. Incluso con la provisión de normas de protección vinculantes para el país, éstas se incumplen habitualmente. Se necesitan acciones efectivas, no meramente performativas, para garantizar la protección de los pueblos tradicionales y eliminar el riesgo de que el país sea responsabilizado ante la Corte Interamericana.O presente artigo tem por objetivo comparar a prática extrativa de ouro na amazônia brasileira com os padrões nacionais e internacionais de proteção de povos tradicionais. Estes povos são frequentemente afetados por atividades econômicas que impactam o meio ambiente, inclusive especialmente devido às especificidades de sua cultura, que frequentemente incluem relações particularmente próximas com o ambiente em que habitam. Utilizou-se o método hipotético-dedutivo, postulando que o país não tem protegido estes povos. Para confirmar a hipótese, foi comparada a conduta do Estado brasileiro com os marcos normativos nacionais e internacionais de proteção de direitos humanos e de povos tradicionais, identificados nas decisões da Corte Interamericana de Direitos Humanos e do Supremo Tribunal Federal pelo método de análise jurisprudencial. Foi possível observar que o Brasil não age conforme os padrões ditados pela Corte Interamericana e por sua própria corte constitucional, e assim, os povos tribais ficam à margem da proteção estatal e sofrem com os impactos negativos da extração do ouro por mineradoras e seus subprodutos. Mesmo com a previsão de padrões de proteção vinculantes ao país, estes são rotineiramente desrespeitados.
