Corporate governance and human rights: an empirical analysis in “novo mercado”

Resumo: | This project identifies the practices of Brazilian companies regarding to human rights, within a perspective of corporate governance. The research examined the companies’ public documents registered in the Comissão de Valores Mobiliários, in 2013 and 2017, and identified the companies that have human rights programs through key terms. The hypothesis developed is that Brazilian companies, from 2013 to 2017, have showed an increased implementation of human rights policies in companies related to risk prevention image, improved relations with employees and customers and attracting investors. Nonetheless, even considering that a marginal improvement was identified, the number of companies which implements even partially the United Nations Framework for Human Rights and Business is very reduced, what is particularly relevant in a country characterized by many violations of human rights such as Brazil. The research was developed mainly over analysis in the Formulários de Referência of public companies of the Novo Mercado segment, registered before CVM. |

Nesse sentido, a pesquisa analisou documentos de companhias abertas registradas perante a Comissão de Valores Mobiliários (CVM), buscando identificar quantas companhias apresentam programas de direitos humanos, numa análise comparativa entre os anos de 2013 e 2017. A hipótese que foi desenvolvida é a de que as companhias brasileiras, entre os referidos anos, apresentaram um aumento na implementação de políticas de direitos humanos, relacionados com a prevenção de riscos de imagem, melhoria nas relações com empregados e clientes e captação de investidores. No entanto, apesar de ter sido identificada uma pequena melhora, o número de empresas que implementa ao menos parcialmente os princípios das Nações Unidas para Direitos Humanos e Negócios é muito reduzido, o que é particularmente grave em um país marcado por inúmeras violações de direitos humanos como o Brasil.
